1. Agreement to Terms

By downloading, installing, or using Tides ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Tides ("we," "our," or "us"). We may modify these Terms at any time, and your continued use of the App after such modifications constitutes acceptance of the updated Terms.

2. Important Medical Disclaimer

Please read this section carefully.

Tides is a fasting tracking tool designed to help you monitor your fasting schedule. It is not a medical device and does not provide medical advice, diagnosis, or treatment.

  • The biological phase information (ketosis, autophagy, etc.) is based on general scientific research and may not accurately reflect your individual metabolic state.
  • Fasting may not be appropriate for everyone. Certain medical conditions, medications, and life stages (pregnancy, breastfeeding, childhood, elderly) may make fasting dangerous.
  • Always consult a qualified healthcare provider before starting any fasting regimen, especially if you have diabetes, eating disorders, heart conditions, or any other medical conditions.
  • If you experience dizziness, fainting, extreme fatigue, heart palpitations, or any other concerning symptoms while fasting, stop immediately and seek medical attention.

By using Tides, you acknowledge that you are fasting at your own risk and that we are not responsible for any health consequences resulting from your fasting activities.

3. Eligibility

You must meet the following requirements to use Tides:

  • You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction).
  • If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have permission from a parent or legal guardian.
  • Fasting is generally not recommended for individuals under 18 without medical supervision.

4. Description of Service

Tides provides the following features:

  • Fasting Timer: Track the duration of your fasting periods with various preset modes (16:8, 18:6, 20:4, OMAD, extended fasts) or custom schedules.
  • Biological Phase Tracking: Approximate indicators of metabolic states based on fasting duration (these are estimates, not medical measurements).
  • The Tide: A real-time count of other users currently fasting (available to Pro users).
  • Achievements: Milestone tracking for completed fasts and total fasting hours.
  • Widgets: Lock screen and home screen widgets displaying fasting status.
  • Health Integration: Optional sync with Apple Health (iOS) or Google Fit (Android).
  • History & Statistics: Records of past fasting sessions and trends.

5. Free and Pro Tiers

Free Tier

The free version of Tides includes core fasting timer functionality, basic fasting modes, biological phase tracking, personal achievements, basic widgets, fasting history, and health app integration.

Pro Tier

Tides Pro is available as a one-time in-app purchase and includes:

  • Access to "The Tide" - live count of users currently fasting and ambient glow visualization
  • Extended fasting mode presets (36h, 48h, 72h+)
  • Community achievements
  • Enhanced widgets with tide visualization
  • Detailed statistics and trends
  • Weight and mood tracking
  • Data export
  • Theme customization

6. Purchases and Payments

  • Payment Processing: All purchases are processed through Apple App Store (iOS) or Google Play Store (Android). We do not directly collect or store payment information.
  • Pricing: Prices are displayed in your local currency and may vary by region. Prices are subject to change.
  • Family Sharing: Tides Pro supports Apple Family Sharing and Google Play Family Library. A single purchase can be shared with up to 6 family members.
  • Multi-Device: Your purchase is tied to your Apple ID or Google account and can be restored on any device signed into that account.
  • No Cross-Platform Transfer: Purchases on iOS cannot be transferred to Android, and vice versa.
  • Refunds: Refund requests must be submitted to Apple or Google according to their respective refund policies. We do not process refunds directly.

7. Acceptable Use

When using Tides, you agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to our systems or other users' data
  • Interfere with or disrupt the App's functionality or servers
  • Reverse engineer, decompile, or disassemble the App
  • Use automated systems or bots to interact with the App
  • Manipulate the Tide count or other shared features
  • Impersonate any person or entity
  • Upload malicious code or attempt to compromise security

We reserve the right to suspend or terminate access for users who violate these terms.

8. Intellectual Property

All content, features, and functionality of Tides—including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof—are the exclusive property of Tides or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

9. Third-Party Services

Tides integrates with third-party services:

  • Firebase (Google Cloud): Backend infrastructure and data storage
  • Apple Health / Google Fit: Optional health data integration
  • Apple App Store / Google Play: App distribution and payment processing

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.

10. Disclaimers

Please read carefully

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, error-free, or secure
  • Any defects will be corrected
  • The biological phase information accurately reflects your individual metabolic state
  • The App will meet your specific health or fitness goals
  • The Tide count is 100% accurate at all times

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TIDES, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Any health issues, injuries, or medical conditions resulting from fasting
  • Loss of data or fasting history
  • Errors in biological phase calculations
  • Service interruptions or downtime
  • Unauthorized access to your data

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for Tides Pro, if any.

12. Indemnification

You agree to indemnify, defend, and hold harmless Tides and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any health-related claims resulting from your fasting activities

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms.

You may stop using the App at any time by uninstalling it from your device. Upon termination, your right to use the App ceases immediately.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania. Any disputes arising from these Terms or your use of the App shall be resolved in the competent courts of Romania.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tides regarding your use of the App and supersede all prior agreements and understandings.
